Oracle appeals Android infringement case

In a filing with the United States Court of Appeals for the Federal Circuit, Oracle has appealed the decision in its copyright and patent infringement case against Google. The case, which concerned alleged violations of Oracle's Java-related patents and copyrights by Google in its Android operating system, was thrown out by the Northern District Court of California in June.

As part of the earlier trial, which was originally brought by Oracle in 2010, several of Oracle's patents covering Java were declared invalid. Oracle had then concentrated on the alleged copyright infringement by Google in its Dalvik virtual machine, but since the jury remained undecided on the infringement, Judge William Alsup had decided that Java's APIs were not covered by copyright in this case.

It was generally expected that Oracle would appeal the decision, and with the case being moved to the next level of jurisdiction, it is likely that both the patent and copyright infringement complaints will have to be evaluated again by a new judge and jury.
