Zango's lawsuit against anti-spyware vendor rejected

Adware company Zango, which was previously incorporated as 180solutions before merging with Hotbar to form Zango, has been pursuing a lawsuit against PC Tools. Zango accused the vendor of unfair practices, as the latter's anti-spyware software impedes the function of Zango's software by detecting it as adware.

Judge John C. Coughenour, sitting in Seattle, has now dismissed the suit. Zango had not proved that the anti-spyware software was unfair or misleading, as users were downloading it deliberately in order to avoid potential malware. Anti-spyware programmes are therefore permitted to detect Zango software.

Anti-spyware vendors and the anti-virus industry are increasingly finding themselves the subjects of legal disputes with adware companies. The adware companies are, not unnaturally, displeased at having their products classified as malware. This has prompted anti-virus software vendors to introduce a new malware class, "potentially unwanted programs".
