Actually it is important to remember that the original case that SCO
brought against IBM was probably only possible in the US. Despite
loudly claiming that millions of lines of Unix code were copied into
Linux, when it came to actually presenting any evidence of this Darl
failed completely. In fact Judge Kimball in one of the hearings
expressed his astonishment at the almost total lack of supporting
evidence.
SCO subsequently changed its claim and attempted to base it on some
nebulous concept of "methods and procedures" ... but has to this day
not presented a single line of Code that it owns and which was
"stolen" from SCO by Linux.
In this light the whole claim is really just another example of the
absurd situation in the US where it is not necessary to present a
basic case at the time of making a claim before the court. Even after
extensive discovery SCO failed to find anything to justify the
original claim. Since then its been all downhill and the whole action
is little more than an attempted extortion on the part of SCO. It is
significant that SCO has revealed itself to be acting with an
astonishing lack of moral fortitude and ethics. It is difficult to
escape the conclusion that SCO is simply trying to generate FUD and
to damage not only Linux, but the whole concept of Open Source. They
deserve to fail. My bet is that they will fail.
