You forget that the only thing that restrains the Monopoly is doing
anything too heavy-handed so that the masses would realize the
Monopoly was misbehaving. They feel entitled and they haven't given
up taking over every market they enter. These quotes need help:

Well, Duh! The Linux patents are in the complaint. What is covert
about that? Why do we know about it? Why are you and so many others
writing about it? Seems pretty overt.

TomTom and Zemlin says there is no reason to doubt that is the case,
or to suspect a move against the Linux ecosystem."----
Take the clue above Z --"overt." Here is a lesson in Monopolyspeak:
when they say that they have "Open XML" it is not open. When they
say they want standards that all can use, they mean only their
standard. They speak in PR. They lie. They are going after the
world with patents because their monopoly is threatened by Linux and
the cloud. They didn't leave those patents out. They want every
chief technical officer to know it. The Monopoly salesmen will
remind them.
Monopoly assurances are just another way of repeating the threat.
They are using the Linux patents to beat a Linux user down. TT's
options are to cave in or be destroyed. The Monopoly has that much
power. They have a war chest of billions. That can buy lawyers, pr,
laws, and contracts. No one can match them.
------"Zemlin says that if the case does result in a threat to Linux
then the Foundation is well prepared to defend Linux and that the
"Linux ecosystem has enormously sophisticated resources available"
for its defence."-----
Surely, Linusians know to help and make it expensive and risky for
the Monopoly. After sicking SCO on Linux, Monopoly are now doing it
themselves. Many have surrendered and taken out a license on these
sham US Patents. It's cheaper and you can stay in business longer.
TT should give them a fight so they will quit bullying and try
innovation. It is time for counter-patents. Everyone knows since
Bilski that the US Patent office issues wet noodle patents. But they
are still out there and the court has to treat them like real
patents. The Monopoly can drown almost anyone in litigation costs no
matter the merits.
The abuse of a questionable patent system is starting to turn heads.
Even our villainous Monopoly is victimized by it immensely. They at
once call for reform, but use it as a tool like their "troll"
tormentors. Let's hope your suggestion of reform has some currency.
